1. Agreement to Terms
By accessing or using websail.app ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.
2. Description of Service
websail.app provides Website-as-a-Service solutions including website design, hosting, maintenance, and deployment services. Our services are offered through subscription plans (monthly or lifetime) that include professional website creation, unlimited updates, security monitoring, and dedicated support.
3. Subscription Plans
We offer the following subscription options:
- Monthly Plan ($199/month): Includes full website design, hosting, SSL certificate, SEO optimization, 4 free content/design changes per month, domain support, security monitoring, and access to client dashboard.
- Lifetime Plan ($4,999 one-time): Includes everything in the Monthly Plan plus lifetime hosting and maintenance, priority updates for 12 months, permanent domain ownership transfer, analytics and SEO consultation, free redesign after 2 years, and priority support channel.
4. Payment Terms
Monthly subscriptions are billed automatically each month through PayPal. Lifetime plans require a one-time payment. All prices are in USD and exclude applicable taxes. By subscribing, you authorize us to charge your designated payment method for the subscription fees.
5. User Responsibilities
As a user of our Service, you agree to:
- Provide accurate and complete information during registration
- Maintain the security of your account credentials
- Not use the Service for any illegal or unauthorized purpose
- Not upload or transmit content that infringes on third-party rights
- Comply with all applicable laws and regulations
6. Intellectual Property
The Service and its original content, features, and functionality are owned by websail.app and are protected by international copyright, trademark, and other intellectual property laws. Upon full payment of the Lifetime Plan, you receive ownership of your website content and design. Monthly subscribers retain ownership of their content but license the website design during active subscription.
7. Service Availability
We strive to maintain 99.9% uptime for all hosted websites. However, we do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance with advance notice. We are not liable for any damages resulting from service interruptions beyond our reasonable control.
8. Limitation of Liability
In no event shall websail.app, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
9. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately. For monthly subscribers, you may cancel your subscription at any time through your dashboard or by contacting support.
10. Changes to Terms
We reserve the right to modify or replace these Terms at any time. We will provide notice of any significant changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
